Terms of Use

Business operator Andra Sproge, reg. no. 11047712085, address: Pludmales iela 16, Vecumnieki, Vecumnieku parish, Bauska district, LV-3933, hereinafter referred to as the online store, provides the website content and delivers goods/services in accordance with the Terms of Use outlined below.

1. General Terms

When a consumer purchases goods/services through the website, such mutual agreement is considered a Distance Contract and is subject to the laws of the Republic of Latvia governing distance contracts, including but not limited to the Republic of Latvia “Consumer Rights Protection Law”, Cabinet of Ministers Regulations “Regulations on Distance Contracts” and others.

2. Making Purchases

Prices and specifications of products sold in the online store are shown next to the products.

Custom-ordered Anda Sproge Art products may take up to two calendar weeks to produce.

To place an order, add desired products to your shopping cart. Fill in all required fields. Complete the payment to finish your order.

3. Payment Terms

The currency on the website is euro. Purchases can be paid for using the following payment methods provided by the payment platform makecommerce.lv, Maksekeskus AS:

  • Latvian internet banking payments: Swedbank, SEB, Citadele and Luminor
  • Visa/Mastercard card payments

NOTE! When using internet banking payment method, confirm your order and click the “Return to merchant” button.

Personal data required for payment processing is transferred to the licensed payment institution Maksekeskus AS.

The contract takes effect upon successful payment to the online store’s bank account. If for any reason the order cannot be fulfilled, the Buyer will be notified and the paid amount will be refunded as soon as possible, but no later than 14 days after receiving the notification.

4. Delivery Terms

Products are delivered to the following countries: European Union member states. Purchased products are delivered using: parcel locker delivery partners, courier or postal services.

In the Baltic states, delivery is made through Omniva parcel lockers or Omniva courier service.

  • Delivery in Latvia – €2.90
  • Delivery to Estonia and Lithuania – €4.90
  • Delivery outside the Baltic states to any other European Union member state is calculated separately, with the customer being informed accordingly. All duties and taxes payable to receive the shipment at the destination must be covered by the Buyer.
  • Products can be collected FREE OF CHARGE at Pludmales iela 16, Vecumnieki, Vecumnieku parish, Bauska district, LV-3933, after receiving a confirmation email when the product is ready for pickup.

Product manufacturing and shipping to the customer may take up to 20 days. In exceptional cases, we reserve the right to ship products within 45 calendar days, informing the customer accordingly.

5. Right of Withdrawal and Product Returns

According to the Republic of Latvia Cabinet Regulation No. 255 of 20.05.2014 “Regulations on Distance Contracts”, the buyer has the right to withdraw from the contract within 14 calendar days after receiving the goods, without giving any reason, and return the items purchased from the online store. Depending on the situation, the buyer is entitled to a refund, product exchange, and/or compensation as appropriate.

To exercise the 14-day right of withdrawal, products may only be used for their intended purposes, and the consumer is responsible for maintaining the quality and safety of the product during the withdrawal period. If products are inappropriately used or damaged through careless handling or failure to follow instructions, if the original packaging is lost, or if the packaging is significantly damaged, the online store has the right to reduce the refund amount according to the decrease in product value.

The Anda Sproge Art online store provides the option to return or exchange purchased products using the platform atgriesana.omniva.lv

  • Fill out the product return form on atgriesana.omniva.lv platform HERE.
  • After completing the return form, information with the return shipment code and further instructions will be sent to your provided phone number and email.
  • Go to the nearest Omniva parcel locker, select “Send shipment” > “Shipment with pre-prepared address card” on the screen, enter the return shipment code and follow the further instructions on screen.
  • Please note that product returns via parcel locker are possible only if the package size does not exceed 38 x 64 x 39cm and its maximum weight does not exceed 30kg.

Money will be refunded within 14 days at the latest from the moment the return form is submitted on atgriesana.omniva.lv

The seller has the right to withhold payment until receiving the Product or proof of return from the Buyer. If the buyer has chosen a shipping method other than the cheapest shipping method offered by the online store, the online store is not obligated to compensate for the excess shipping costs.

The online store is not responsible for delays in fulfilling obligations or non-fulfillment, or any other type of non-performance caused by circumstances and obstacles beyond the reasonable control of the online store.

The online store reserves the right to refuse to sell products and demand product returns from the Buyer if the price stated in the online store is significantly lower than its market price due to an error.

The Buyer fully covers the product return costs at their own expense.

6. Consumer Rights Regarding Non-Conforming Products

The online store is responsible for products sold to the Buyer that do not comply with contract terms or have defects that occurred within 6 months after the delivery date to the customer, or existed at the time of delivery, if such assumption is not contrary to the nature of the item or defect. The Buyer must inform the Seller about product non-compliance immediately, within 2 months of discovery, i.e., submit a complaint. The Buyer can submit a complaint by contacting the online store by writing to info@andasprogeart.lv

The online store is not responsible for defects that occur after product delivery to the Buyer. If purchased products have defects for which the Seller is responsible, the Buyer has the right to request defect correction or replacement with new products free of charge.

If the products cannot be repaired or replaced, the Seller will refund all payments specified in the Distance Contract. The Seller will provide a written response to the consumer’s complaint within 15 days.

7. Processing of Buyer’s Personal Data

The online store processes only the personal data that the buyer has entered when ordering products, such as name, surname, email, etc.

The online store transfers personal data to transport service provider(s) to ensure product delivery.

If you have explicitly agreed to receive our marketing communications, including news, we may occasionally contact you with information about our services and latest offers. For this purpose, we may process your email address, which you provided when signing up for marketing communications. The buyer can opt out of marketing communications by notifying us by writing to info@andasprogeart.lv

8. Dispute Resolution

In matters not covered by these terms and conditions, the Buyer and Seller undertake to comply with the legislation in force in the Republic of Latvia.

The parties shall resolve all disputes between the Seller and Buyer through mutual negotiations or correspondence. If the dispute cannot be resolved through negotiations or correspondence, the Parties shall resolve the dispute in a court of the Republic of Latvia, following the laws of the Republic of Latvia. Disputes between the Buyer (consumer) and Seller may be submitted for resolution to the Consumer Rights Protection Centre or a court of the Republic of Latvia.

The Buyer also has the right to turn to European Union dispute resolution bodies.
